Rules and Regulations

RULES AND REGULATIONS     ———————  Effective May 22, 2010

Please help keep our community; our lake, Lake House and Parks, Safe and Clean. As residents and OWNERS we jointly have a vested Interest in Maintaining These. The rules and regulations are put in place to ensure the respoect and protection of our liabilities, on our commmon lands.

1.         Valid access cards must be used to enter the Lake House, Upper Lake and any other controlled private amenity areas. Access cards are to be used only by the resident to whom it was assigned. * All eligible residents 14 years of age and older can be issued a card. This is avoid residents within the household having to share cards; as cards are only to be used to whom it was issued.

2.         Each household will have only 2 Adult Owner Resident Members. Adult residents may take a reasonable number of guests into the Beach Club, subject to the discretion of the Lake House Staff/ Directors. All others, age14 and older, within the household will be considered Minor or Junior members and shall have no more than two guests at one time. This privilege will not be extended to renters as they are not owners.

3.         All guests must be accompanied by a resident at all times.

4.         The members will be held responsible for any violation of these rules and regulations by their guests, in adherence to the conditions of the resident waivers against your property.

5.         No persons will be permitted in to the Lake House and park area later than the summer posted hours. The only exception to this is an officially booked, Private Event. *Gates are disabled during the evening hours. Violations will not be tolerated.

6.         Association employees, Directors, and security guards have the authority to enforce all rules and regulations. Residents that have concerns are asked to please advise staff. Residents that are seeing serious / suspicious activities, please call the RCMP or 911. Reaction by law officials to offenses has statistical significance, so please make it count.

7.         Glass bottles, dishes, or any other glass products are strictly prohibited at the Lake House park areas, and all Association property; including, beach, lake, on the ice.

8.         No liquor allowed at any time at the Lake House or any Association property with the exception of authorized private functions, which require proof of a Liquor Permit and * Party Alcohol Liability  insurance provided, and then ONLY IN the Lake House.

9.         * ANIMALS ARE NOT PERMITTED IN THE LAKE HOUSE AREA OR IN THE LAKE AT ANY TIME, * INCLUDING, IN THE UPPER LAKE. As the Upper Lake water feeds into the lake and this water is used from time to time as drinking water. In addition, there are electrical hazards and other hazards present in the Upper Lake. Animals are permitted in the Upper Lake Park but are restricted to green space areas only.  Animals MUST be leashed and under the care and control of the handler AT ALL TIMES.  Handlers MUST clean up after their animals.

10.       No open fires are allowed.

11.       Bicycles are permitted in park areas provided cyclists use paved walkways.  Cyclists MUST yield to pedestrians.

12.       Member residents are encouraged to ensure they remove all their belongings when leaving the common areas. Personal property is not permitted to be left, on any Association property. The Association can not be held responsible for any property left, and it will be removed and discarded.

13.       The Lake House hours of operation will be determined by the Owners Association Board of Directors and will vary by season. Please see the signage as posted at the Lake House entrance.

LAKE ACCESS CARDS

Only Resident Home Owners, with authorized guests are entitled to use and enjoy all of the recreation amenities including the Lake House and the beach area, Sports Court and Upper Lake Park and any other controlled area.  These amenities are only accessible with an Access Card.

New Resident Home Owners should visit the Lake House to obtain Lake Access Cards., upon taking possession. You are invited to call the Lake House Office at (403) 263-5540 to make those arrangements. You will be required to fill out a family information form, and required to complete and sign a waiver regarding liability issues. A copy of your new resident land title will be required, in addition to photo identification for your family, to verify your new address. Once this information has been confirmed, we will call you, and your can pick up your new cards. We do this to ensure that Lake Access Cards are not issued to non- owners. The amenities are owned by the Lake Owners Association and are not available to the public at large. Access Cards will NOT be issued without providing complete information.

Resident Owners and *all eligible members over the age of 14 (ID required) can be issued an access card. This will ensure that all eligible members have their own card and not required to share. Your card is your responsibility and to be used only by the member to whom it was issued.

Lost cards can be obtained at the Lake House at a cost, and replacements currently $25. (Subject to change) Please bring all family cards in at the same time so we can verify the lost/missing card. We recommend putting initials or name on your cards, for that reason. Please bring photo ID.

THE LAKE HOUSE

As residents of the Lake at Heritage Pointe, you will have access to the Lake House and your friends are always welcome.  Each homeowner will have a lake access card that will give them access to the Club and its facilities.  An adult homeowner (18 years of age or older) must accompany guests at all times and you are responsible for your guests.  The age has been increased from 16 to 18 years as advised from our community lawyer.

Please note that the Lake House is not open at all times.  The current hours of operation are:

  • Winter Hours: ( staffed )

NEW ** 11 AM – 4PM daily,    7 days a week, including Statutory Holidays (except Christmas Day)

  • Summer Hours: ( staffed )

11:00 AM to 9:00 PM daily , from the May long weekend to the September long weekend.

** Lake Gates will be disabled and access will not be permitted after hours** ( evening only, for security purposes)

We will enable the gates for use of the premises, unattended  at 9 AM.during the summer hours  for adults and supervised minors only.

WATER CRAFT

(Row Boats, Canoes, Windsurfers, Paddleboats)

1.         LIFE JACKETS MUST BE WORN WHEN BOATING. Life jackets can be obtained at the Lake House and must be worn at all times while on the water in a rowboat, canoe, windsurfer or paddleboat.

2.         Careless and dangerous operation of any watercraft will promptly result in loss of boating privileges.

3.         No gas-powered motorboats shall be operated on the Lake.  Electric motors are permitted, provided special sealed batteries are used; to prevent lake contamination.

4.         *No person under the age of *18 years shall be issued a canoe, rowboat or paddleboat by the Lake House staff. Resident members aged 14-17 may be issued a canoe, rowboat or paddleboat with a signed parental consent form/letter on file at the Lake House office. ID may be requested.  All passengers under age 18 must either have a parental consent form on file or be accompanied by a responsible person at least 18 years old.

5.         In the event of a craft capsizing, STAY WITH THE craft AND AWAIT HELP.

6.         All boats on the lake should immediately come ashore if potentially hazardous conditions arise such as poor visibility, high winds, lightning or storms.

7.         Beaching of Owners Association canoes, rowboats or paddleboats is allowed at the Beach Club only.  Lake residents are allowed to beach their craft wherever necessary at their own risk.

8.         No more than 4 people in a boat or 2 people in a canoe or paddleboat.  No exceptions.

9.         No docking at private docks without approval of the homeowner.

10.       No issuance of row boats, canoes or paddleboats 45 minutes before the Lake House closes, and must be returned 15 minutes prior to posted closing  time.

11.       Private boats used in foreign waters MUST be cleaned prior to launching, to prevent algae contamination of our lake. As lake water may be used as drinking water reserve.

12.       Member resident access cards must be left with the Lake House office when using any Owners Association water craft or recreation equipment.

13.       Swimming and boating in the Upper Lake is STRICTLY PROHIBITED. There are electrical hazards that are present in those waters.

FISHING

1.         Fishing privileges are restricted to 2 guests per member.  The member must accompany guests when fishing.

2.         LIMIT IS 3 TROUT PER DAY PER MEMBER/GUEST COMBINATION.  MAXIMUM MONTHLY LIMIT is 10 Trout per HOUSEHOLD.

3.         Each person fishing may have only one line in the lake at a time.

4.         No live bait may be used.

5.         Boats and fishing tackle must remain 50 feet from the beach and the creek area.

6.         Fishing within 25 feet of private or public docks is prohibited.

7.         The Owners Association reserves the right to close the lake to fishing at times such as fish stocking, weed treatment, unsafe ice or other reasons*.

8.         Ice fishing holes must be made by an ice auger, may not be larger than 8 inches in diameter and must be identified with an orange pylon.  NO HOLES MAY BE DUG IN ANY CLEARED SKATING AREA.

9.         Boat anchors of any type are not allowed. Damage of the lake liner may occur with use of any anchor.

PLEASE HELP KEEP OUR BEACH CLUB AND PARK AREAS SAFE AND CLEAN

Violation of any Owners Association Rules and Regulations may result in suspension or loss of privileges.  Homeowners must respect the privacy of all residents.Association Rules and Regulations are subject to amendment without notice.

SPORT COURT

The Lake at Heritage Pointe “Sport Court” provides a superior playing surface for basketball, volleyball and short court tennis.  Because the court surface material is costly and subject to damage when abused, the following restrictions are necessary.

1.         The use of the court is limited to tennis, basketball and volleyball.

2.         Players require proper athletic footwear.

3.         Jumping, hanging, sitting or leaning on the tennis or volleyball net is strictly prohibited.

4.         Chairs or other hard objects shall not be placed on the court surface.

5.         Maximum court time is 45 minutes when others are waiting for a court.

6.         Hanging on the basketball hoop is strictly prohibited.

7.         * All access to sport court must by use of card access only. *Climbing over fencing to gain access is strictly prohibited, and may lead to disciplinary action.

CYCLING, IN-LINE SKATING and ICE SKATING

1.         Hockey sticks and pucks are allowed on the designated hockey ice only.

2.         Homeowners may clear the lake for skating.  No boards, boundaries, beaches, lighting, fire pits or the like are allowed on the Lake or Upper Lake.

3.         No roller blading is permitted, except on pathways outside of the Lake House and Upper Lake areas.  Please be respectful in giving walkers the right-of-way.

COMMUNITY GATED PARKS, OPEN SPACES, PATHWAYS

The Lake at Heritage Pointe has an abundance of natural and man-made amenities for all members of your family to enjoy.

There are three primary amenity areas:  The Lake, Community Open Space and Natural Areas.  Each of these amenity areas is available for your enjoyment.

Specified Community Open Spaces and the Lake belong to the Owners Association and access in some cases is restricted. An Access Card is required to use the Lake House, beach and playground area, the sport court amenity and Upper Lake.  Some community open spaces, while private, are not entry controlled.

*The community pathways exist through out the entire community. The gated pathways need to remain closed as these areas offer potential liability to the Association. Please report any misuse, or damage and especially vandalism, as it comes at a cost. Call the Lake House staff for any concerns. For vandalism or suspicious activity call the RCMP or 911. It is a primary concern for all those who live, in the community to make an effort to keep the pathways and common land clear of debris and safe for all of us. Damage costs all of us. *Any malicious damage of gates operation will be dealt with using the full extent of the law.

PETS

Pets may be exercised anywhere in the community except at the Lake House area and, MUST BE LEASHED AT ALL TIMES. Currently the M.D. is revising its Dog Control Bylaws, 2010. The current bylaw can be viewed and a report offenders to the M.D. of Foothills www.mdfoothills.com , phone (403) 652- 2341

Pet owners are responsible for controlling and cleaning up after their pets immediately. Remains are not only distasteful, but unhealthy and our cleanup of your pet is a cost to all Resident Owners. Please clean up to maintain the excellent quality of the lake and beach area.

NO PETS ARE ALLOWED ON THE BEACH OR IN THE LAKES at anytime.

The following is an excerpt from the Encumbrance Agreement for Heritage Pointe (The entire document can be viewed in the “Restrictive Covenant and Encumbrance Agreement” obtained from your lawyer/advisor.):

No animal (except a domestic dog or a domestic cat), bird or reptile (all of the foregoing including domestic dogs and cats being hereinafter referred to as a “pet”) of any kind exceeding ten kilograms shall be kept on any Subdivided Lot without the prior written approval of the Approving Authority, and the Approving Authority may, if such approval has been given, withdraw such approval on fifteen days notice to the owner of the Subdivided Lot on which the pet is being kept.  An owner of a Subdivided Lot shall not keep in or on the Subdivided Lot more than four pets (excluding fish) of which no more than two shall be dogs and no more than two shall be cats.

RV STORAGE

* Offsite storage is available for RVs, trailers, boats and other recreational equipment within easy driving distance of The Lake at Heritage Pointe. Trucks larger than ¾ ton, recreation equipment and recreation vehicles of any kind, cannot be stored within the community, and a 48-hour parking limit will be enforced while loading and unloading. *Overnight parking of any kind is not permitting on any Association Property.
